Motörhead’s Motörboat Terms & Conditions Are Subject To Change At Any Time

Please read the following Terms and Conditions BEFORE you book your cabin on the cruise. These documents contain important limitations on your rights. These are legally binding documents. This document contains additional contractual terms, conditions, and limitations between you, Motörhead’s Motörboat, LLC, ASK4 Entertainment, LLC, and Whet Travel, Inc. (“Motörhead’s Motörboat” or “MB″ or “Cruise”), or their respective officers, directors, employees, agents and contractors (collectively referred to herein as the “Released Parties”), with respect to this cruise beyond the terms and conditions described in the Norwegian Cruise Lines (NCL) Passenger Contract (“NCL Passenger Contract“).
All references to “Guest” shall have the same meaning as “Passenger” for purposes of this Contract and shall include each person listed on a Ticket Contract and each person, other than MB-ASK4-Whet personnel, NCL personnel, and performing artists and artist personnel, who embarks on the Cruise or attends any Cruise or Cruise related event, whether or not listed on a Cruise Ticket Contract. All terms shall be considered gender neutral and pronouns shall refer to the masculine and feminine as context requires.
Ticket Contract
By making this reservation, or by acceptance and/or use of the NCL Passenger Contract, the person named thereon as Guests, each passenger and guest on the same reservation, acknowledges he or she has read, and understands each and every term, condition, and provision of the NCL Passenger Contract and agrees to be bound thereby. In addition, by making this reservation or by the acceptance and/or use of the NCL Passenger Contract by the persons named as Guests, it shall be deemed to bear acceptance and agreement by each and every person to all the additional Terms and Conditions set forth herein.
Guest acknowledges and expressly agrees MB (and its affiliates) are acting solely in their capacity as tour operators, brokers and independent contractors arranging this cruise and that MB has no right or ability to control or direct the operational or navigational activities of the vessel or crew in any manner whatsoever whether aboard the ship or ashore including without limitation persons furnishing services to the vessel or to the guests including shoreside excursions, personnel, or contractors, embarkation and disembarkation to and from the vessel, the condition of the vessel and its equipment.
All rights, defenses, disclaimers and limitations of liability set forth herein shall inure to the benefit of MB, and all concessionaires, independent contractors or other providers of any services or facilities in connection with or incident to the Guest’s cruise, as well as any of their affiliated or related companies, parents, subsidiaries, successors, assigns or fictitiously named entities; and all suppliers, shipbuilders, component part manufacturers; and their owners, operators, managers, charterers, agents, pilots, officers, crew, employees and vessels. Neither MB, nor any of its employees have any authority to change, modify, alter or suspend any of the provisions of the Contract between the Guest and NCL which shall govern the relationship between Guest and Norwegian Cruise Lines exclusively.
Nature Of The Cruise
Motörhead’s Motörboat 2015 is an event cruise featuring multiple headline musicians. Nothing contained herein is intended to be, nor shall it be construed as a right or guarantee to specifically attend any particular concert on any particular date to be performed by any particular artist. MB-ASK4 and Guest agree that Guest is purchasing passage on board a specific vessel during a specific period of time during which time it is anticipated that headline musicians will perform multiple concerts on board the vessel during the Cruise. Included in such purchase price, but ancillary thereto, is an entertainment package pursuant to which several artists will perform at a time or times during the Cruise which times will be announced prior to sailing and/or during the Cruise. While every effort is made by MB-ASK4 to avoid conflicting events and performances, MB-ASK4 cannot guarantee that any Guest will be able to attend every performance aboard the Cruise. It is also anticipated individual musicians will attend publicity and promotional events during the Cruise while on board to provide Guests an opportunity to meet the musicians in person. However, MB-ASK4 can make no guarantee that any guest will in fact be able to meet any of the musicians in person during the Cruise or during any shore excursion.
Cruise Fare
Includes all Motörhead’s Motörboat talent/entertainment related fees, your accommodations on-board the ship, all meals in the main dining room(s) and cafeteria, other casual dining throughout the day, non-carbonated beverages (coffee, tea, juices, etc), 24-hour room service (a convenience charge of up to $7.95 will be added to each order), use of the ship’s pools, health and fitness centers.
Your cruise fare does not include government fees and taxes, onboard gratuities, fuel surcharges, transportation to/from ship, shore excursions, sightseeing or meals ashore, meals in specialty and à la carte restaurants, laundry, wine, beer, liquors, cocktails, soda, mineral water, medical expenses, spa, beauty salon, casino gaming, onboard shopping, or any other items of a personal nature. Gratuities for ship staff of $13.05 per guest per day will be added to your onboard spending account at the end of the cruise.
You are obligated for the full cruise fare and fees of the occupancy level you select during the reservation process, even should you not provide additional guest information to us.
All prices are subject to change and are based on availability. All rates are per person.
Government Taxes & Fees
Mandatory Government Taxes and Fees totaling $225.00 (USD) will be charged with the balance due on your cabin. These charges are in addition to the Cruise fare and may include, but are not limited to, passenger facility charges, security surcharges, international passenger departure or arrival tax, customs user fee, immigration fee and agricultural inspection fee, and miscellaneous ticking fees.
In the event that the cost of fuel increases between now and the time we sail, NCL reserves the right to impose a fuel surcharge of up to $10.00 per person per day. NCL also reserves the right to impose surcharges for government taxes and fees, security, and incidental costs. The surcharges will be added to the passenger’s cabin costs and must be paid in full by the cruise date in order to board the ship. All passengers will be notified via email if such fuel surcharge is added to the cost of your cabin.
Single Guests
All cabin deposits are based on a minimum of double occupancy. Single guests are responsible for the full double-occupancy rate of their cabin. Single guests will receive a discount of $199 off of the second cruise fare. In all cases, single guests will only be charged one add-on fee of $225 for taxes and fees.
Child Rates
Children 12 years old or younger, booked in staterooms as the 3rd, 4th, or 5th guests, with 2 full-fare adults at the double occupancy rate, may sail for only taxes and fees ($225.00). If a child under 12 is booked as the 2nd guest in the cabin, the full 2nd adult fare still applies, plus taxes and fees.
Guests making their reservations online, will need to book their staterooms at the total occupancy level for all guests, including children. For instance, if 2 adults and 2 children will occupy the cabin, then a Quad cabin must be booked. Upon completion of the online reservation, guests should contact the ASK4 Reservations team at Whet Travel, by calling 877-GET-WHET (438-9438), or by emailing motorboat@whettravel.com in order to have their child rates adjusted, and the adult rate based on the double occupancy rate.
Payment Schedule
There are three payment plans available for Motörhead’s Motörboat guests. The date you make your reservation will ultimately determine your total deposit due at the time of booking and the subsequent payment dates.
Pay In Full
You may pay in full at the time of booking. No additional payments will be needed, unless you later modify your reservation by upgrading/changing your stateroom or by adding additional cabinmates.
Monthly Payment Plan
- $250 per person deposit is due at the time of booking for all Interior, Oceanview and Balcony Staterooms
- $500 per person deposit is due at the time of booking for all Suites
Remaining cabin balance will be split into equal monthly payments beginning on the first of each month following your initial deposit, with the final balance due no later than July 1, 2015. Your monthly payment will be automatically charged to your credit card on file on the first of each month. It is your responsibility to know your due dates; payment reminders will not be sent. Late Payment Fees
For all monthly payment plans, a $10 per month late payment fee will be applied per guest for each cabin that does not remit payment by the required payment deadlines.
For all 50/50 payment plans and final payment for all bookings, a $50 late payment fee will be applied per guest for each cabin that does not remit payment by the required payment deadlines.
Additional Payment Info
Prices are subject to change and are based on availability. All rates are per person. Add $225 per person for taxes and fees, which includes government taxes, port charges, and ticketing fees. Gratuities for ship staff of $13.05 per guest per day will be added to your onboard spending account at the end of the cruise.
Even if you are paying for the entire cabin yourself, you are responsible for the full cruise fare and fees for the number of guests you selected when you booked even if you didn’t provide their contact information.
If you are paying with multiple credit cards, you will need all of the credit card numbers (with expiration date and card verification number) as well as the name and billing addresses for each card. To complete the reservation process, you must provide the appropriate per person deposits AND comply with our payment deadlines based on the date that you book. These deposits can be paid entirely by the lead guest, or can be divided among all cabin mates..
We accept most major credit cards including Visa, Mastercard, American Express and Discover. We will also accept payment by payment by check, only when prior arrangements have been made and when submitted by mail or overnight courier.
We only accept third party credit card payments (from a person not attending the cruise) when a Third Party Credit Card Authorization Form is signed by the card holder. For all bookings made prior to June 24, 2015, if payment in full has not been received by 11:59p-ET on June 24, 2015, Motörhead’s Motörboat reserves the right to consider that reservation cancelled, and to charge the applicable cancellation penalties.
Name Changes, Transfers & Fees
The guest who places a reservation for a cabin onboard Motörhead’s Motörboat will be considered that cabin’s “Lead Guest” and is the “owner” of the reservation. The Lead Guest is therefore solely responsible for initiating or authorizing changes to the reservation, and must agree in writing to any changes made to the reservation, by emailing motorboat@whettravel.com
All guest NAME and CABIN NUMBER changes can be made up until 30 days prior to sailing (if allowed by the cruise line), and will be assessed the following administrative fees per name change:
$50.00 for name and cabin changes through final payment date of June 24, 2015
$100.00 for name and cabin changes June 25, 2015 through August 28, 2015 (30 days before sailing)
$200.00 for name and cabin changes on or after August 29, 2015
No changes of any kind will be accepted within two weeks of sailing
The Lead Passenger is not allowed to change their name within the reservation. At least one original and/or lead guest name must remain on the reservation. If all original guests cancel, this is considered a full cancellation without refund, and name changes will not be allowed.
In all cases of name changes, the NEW guest must make full payment. Once that payment has been made, then the applicable amounts paid by the ORIGINAL guest will be refunded directly to the original guest, less the cost of the name change fee.
All cabin reservation cancellations are non-refundable for any amount or any reason, and forfeits all payments. All cancellation and reservations changes must be submitted in writing via email to motorboat@whettravel.com. The date that such written notice of cancellation is received will determine the applicable cancellation fees per the above schedule. No exceptions will be made.
Cancellation
LINEUP GUARANTEE FOR PRE-BOOKED GUESTS
Prebooked reservations are refundable, less a $25 per person administrative fee, for up to 21-days after the date of our intial artist lineup. After 21 days, all prebooked reservations are non-refundable. All prebook reservation cancellation requests must be submitted in writing by emailing motorboat@whettravel.com.
ALL OTHER MOTORHEAD’S MOTORBOAT DEPOSITS AND PAYMENTS ARE NON-REFUNDABLE
Due to the unique nature of our event, all cabin reservation cancellations are non-refundable for any amount or any reason, and forfeits all payments. There are NO exceptions to our cancellation policies. We strongly recommend the purchase of travel insurance.
All cancellation and reservations changes must be submitted in writing via email to motorboat@whettravel.com. The date that such written notice of cancellation is received will determine the applicable cancellation fees per the above schedule. No exceptions will be made.
If a flight or other delay for any reason prevents you from joining the cruise by the boarding time on the departure date, you will be considered a no-show, and we cannot provide a full or partial refund or credit toward a future cruise. Please note that your decision not to travel due to State Department advisories or fear of travel will constitute cancellation by you. No refund or credit will be given for any unused features or early departures for any reason.
No-Shows
There will no refunds given for those who do not board the ship on time, unused tickets, or after Motörhead’s Motörboat has occurred
Please note the cancellation provisions of these Terms and Conditions apply to the Cruise, regardless of any representations made by NCL, whether in its passenger contract terms or elsewhere. All rights granted to passengers in the NCL contract relating to the payment or refund of cruise fare and to cancellations by passengers shall not be operative.
Cancellation by Performing Artist
MB has entered into an agreement with each performing artist on the Cruise to be present on board the Cruise and to perform in accordance with terms specified therein. However, neither MB nor NCL shall be liable or responsible for failure of any artist or musician to appear on board or to perform under its agreement. Further, neither MB nor NCL shall be liable or responsible for any loss, damage, cost, or expense of any kind to any guest or any other person or entity in the event that such performance is prevented or such loss, damage, cost, or expense is caused by or results directly or indirectly from any act of God, war, fire, collision, directions of underwriters, arrest, order or restraint by any government agency or official acting under color of authority, acts of terrorism, labor disturbances or disputes, civil commotion, weather conditions and considerations of the safety of the vessel (for which the Master shall be the sole judge), breakdowns of or damage to the vessel’s hull or machinery, requisition of the vessel by governmental authority, illness, death of a family member or other cause or circumstance beyond MB’s reasonable control. In the event of any failure of contracted artists to perform during the cruise, MB, in its sole discretion, may engage a replacement artist or artists, or may change, postpone or terminate all or any part of the Cruise or the entertainment program or change the program or itinerary. In such case, MB, shall have no liability to any guest for any loss, damage, cost or expense whatsoever by reason of such change.
Cancellation By Motörhead’s Motörboat-ASK4 Entertainment and/or Norwegian Cruise Lines
In the event of strike, lockouts, riots or stoppage of labor from whatever causes, or for any other reason whatsoever beyond the control of MB or NCL, NCL in its sole discretion may cancel, advance, or postpone any scheduled sailing or call at any port and may (but is not obligated to) substitute another vessel, and neither NCL nor MB shall be liable for any loss whatsoever to guests by reason of such cancellation, advancement, postponement, or substitution. Thereupon, MB shall return to you, if the Cruise is completely canceled, your cabin fare, cruise line transfers and related taxes and fees, or, if the Cruise is partially canceled, a proportionate part thereof. Under such circumstances, MB and the Released Parties shall have no further liability for damages or compensation of any kind. Please note that the availability of any refund for travel insurance and/or other travel products (airfare, hotel, car rental), even if purchased in conjunction with the Cruise, will be determined in accordance with the applicable cancellation policies for such other products or services.
Right To Change Itinerary
MB and/or NCL reserve the right, at any time, to change the cruise itinerary whenever advisable or necessary. In this case, MB and/or NCL will NOT be responsible for any loss or expenses caused by reason of such changes or abandonment. Refunds will NOT be made to guests who elect not to complete the cruise for any reason or cause whatsoever.
Ports Of Call
You assume sole responsibility for your own safety in any port of call. MB and the other Released Parties do not guarantee your safety at any time. You may find information about the scheduled ports of call through the U.S. Department of State, Centers for Disease Control and Prevention and other governmental and tourist organizations. MB and the other Released Parties assume no responsibility for gathering and/or disseminating any such information.
Shore Excursions & Cruise Amenities
You acknowledge that all shore excursions and tours, however conducted; airline flights and ground transportation; and any ship physician, nurse and on board concessions (including, without limitation, gift shops, spa, beauty salon, fitness center, golf and art programs, and video/snorkel concession) are operated by independent contractors. MB neither supervises nor controls their actions, nor makes any representation, whether express or implied, as to their suitability. These services are provided only as a convenience for you, and you are free to use or not use them. You agree that each of the Released Parties assumes no responsibility, does not guarantee performance and in no event shall be liable for any negligent or intentional acts or omissions, loss, damage, injury or delay to you and/or your property in connection with these services. You use them at your own risk.
Age Requirements
Infants sailing onboard an NCL vessel must be at least six months of age at time of sailing. A minor is defined as an individual under 18 years of age at the time of embarkation. A young adult is defined as an individual between the ages of 18 and 20.
Company policy dictates that a passenger under 21 years of age must be accompanied in the same or connecting stateroom by a passenger 21 years of age or older at the time of embarkation.
For passengers under the age of 18 traveling with an accompanying adult, who is not the minor’s parent or legal guardian, a PARENT/GUARDIAN CONSENT RELEASE FORM (PDF) that authorizes the minor’s travel and further authorizes medical treatment in case of an emergency must be delivered to a Norwegian representative at the pier during check-in. Failure to produce this letter at embarkation may result in boarding being denied, with no refund of cruise fare provided.
Note: Two people under the age of 21 may travel together in the same stateroom if they are a married couple and provide proof of marriage to a Norwegian representative at the pier before embarkation.
Passport & Legal Document Requirements
Motörhead’s Motörboat strongly recommends that all of our guests travel with a passport (valid for at least six months beyond the completion of travel). Having a valid passport will enable you to fly from the U.S. to a foreign port in the event you miss your scheduled embarkation, or to fly back to the U.S. should you need to disembark the ship mid-cruise for any reason.

The Western Hemisphere Travel Initiative (WHTI) stipulates the following information with regards to “closed-loop” cruises, which are sailings that originate and terminate in the same U.S. Port. Please note that this information could change at any time without notice.
U.S. Citizens (including children) taking “closed-loop” cruises will be able to enter or depart the country with either a valid U.S. Passport – or – Proof of citizenship, such as an original or certified copy of his or her birth certificate (or a Consular report of Birth Abroad, or a Certificate of Naturalization), along with government issued photo identification, such as a State issued drivers license.
Other acceptable forms of identification include:
- U.S. Passport Cards
- Enhanced Driver’s Licenses
- Trusted Traveler Cards (NEXUS, SENTRI, or FAST)
- Military Identification Cards (for members of the U.S. armed forces on official orders)
- U.S. Merchant Mariner Document (for U.S. citizens on official maritime business)
- Enhanced Tribal Card (where available)
Please note: Baptismal papers and hospital certificates of birth are not acceptable. Voter registration cards or Social Security cards are not considered proof of citizenship.
Children: U.S. and Canadian citizen children under age 16 arriving by land or sea from a contiguous territory may present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, a Naturalization Certificate, or a Canadian Citizenship Card.

Inoculation & Health
All guests must ensure that they are medically and physically fit for travel. The Centers for Disease Control (CDC) and the World Health Organization (WHO) provide guidelines as to which vaccinations are required in each country. In many cases inoculations are recommended but in some circumstances they are required. We recommend that you check with your health care professional or a Travel Medicine Specialist certified by the WHO for guidance. Other informational resources can be accessed at the Center for Disease Control and Prevention’s Traveler’s Health website or toll free at 1-877-FYI-TRIP, and the World Health Organization website.
Pregnant Guests & Guests With Special Needs
By booking the Cruise, you warrant that you, and those traveling with you, are physically fit to travel at the time of embarkation. Boarding will be denied to any person who will enter her twenty-fourth week of pregnancy by the time of the Cruise or during the cruise and to infants under six months old. You must notify MB at the time of booking of any disability or other medical or physical condition that may require special assistance during the Cruise. Your failure to do so will release the Released Parties from any liability for loss, damages or other compensation arising from or related in any way to such disability or condition. MB and NCL reserve the right to require that any guest who is not self-sufficient travel with a companion who shall take responsibility for any assistance needed during the Cruise and in case of emergency.
Medical Care
You assume all risks associated with travel and transportation on the Cruise. While at sea or in port, the availability of medical care may be limited and/or delayed. You acknowledge that all or part of the Cruise may be in areas where medical care and/or evacuation may not be available. You agree to indemnify and reimburse MB and/or NCL in the event that either party, in its sole discretion, to advance to you the cost of emergency medical care, including medical evacuation and/or medical care provided ashore, as well as transportation and/or lodging in connection therewith. MB shall have no responsibility to advance any such costs.
Stage Lighting & Theatrical Smoke
Each performing artist onboard the cruise is contracted individually. While MB makes suggestions and/or recommendations about the use of strobe and lazer lighting lighting, synthetic theatrical smoke, and other stage production elements, the artists’ individual show producers ultimately make the final decisions regarding their performances. Guests who have a medical condition which may be aggravated or exacerbated by strobe lighting, lazer lighting and/or synthetic theatrical smoke, are urged to use caution when attending these perofrmances. Signs warning of the potential usage of these production elements will be posted at performance venue entrances. Cruise guests agree to enter these areas at their own risk, and are solely responsible for removing themselves from any area where these stage production elements are being used.
Luggage
NCL and MB assume no responsibility for carry-on luggage. Any luggage left at the pier will be forwarded at the guest’s expense. Claims for luggage loss or damage must be made in writing to debarkation personnel prior to leaving the pier area. All luggage must be stored in the guest’s cabin. Pets, dangerous or illegal items such as weapons, explosives, combustible substances, non-prescription controlled substances, or illegal drugs may not be brought onboard the ship. Any such items shall be surrendered to security at embarkation and may be disposed of at the sole discretion of NCL Cruise Lines. All luggage, hand-carried or checked, is subject to search.
Roommates/Cabinmates
Your decision to accept a roommate for the Cruise is at your own risk. MB and its Released Parties are not responsible nor liable for any and all claims or cause of action arising out of or in connection with your selection of a roommate for the Cruise, including, without limitation, any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from such request or selection.
Vending
You may not sell, promote, distribute or offer for sale any merchandise, goods, souvenirs or other products on the Cruise without first obtaining written approval from Motörhead’s Motörboat. You may not permanently disembark the Cruise ship, or remove any merchandise from it, at any port in the United States, its districts, territories or possessions, other than at the port of final disembarkation (Miami).
Photography & Video
MB and/or its promotional partners have the exclusive right to include photographic, video and other visual portrayals of guests in any medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to guests, and all rights, title and interest therein (including all worldwide copyrights therein) shall be the sole property of Motörhead’s Motörboat, free from any claims by guests or any person deriving any rights or interest from guest. A video crew will be shooting footage to be use for the promotion of future MB events. When the video team is shooting in any particular location/venue on the ship, your presence in said location/venue acknowledges your permission for your likeness to be used in future, non-broadcast promotional videos or still pictures. If you do not wish to be filmed please notify the video crew and be prepared for them to ask you to exit the location/venue for a short time until taping is complete.
Photo Policy for Guests
Guests are permitted to take personal photos using fixed-lens cameras everywhere onboard the cruise. However, please refrain from flash photography in all indoor concert venues. The use of detachable lens cameras (DSLR, other professional cameras, etc.), tablets (iPads, etc.), and any video or audio recording devices, will not be permitted during shows. We appreciate your cooperation!
Refusal Of Passage
Transportation on the Cruise may be denied to any person who, in MB’s or NCL sole discretion: (1) is or becomes in such a condition as to be unfit to travel; (2) is dangerous or obnoxious to others; or (3) is inadmissible under the laws of any country of debarkation. In addition, MB and NCL reserve the right to refuse passage, disembark or confine to a stateroom any person whose physical or mental condition or behavior they consider, in their sole discretion, to constitute a risk to the person’s own well-being or that of any other person. The Released Parties shall have no liability to any such person or any third party arising out of any such decision. Any costs resulting from MB’s and/or NCL’ decision, including, without limitation, costs of lodging and transportation, shall be the responsibility solely of the person.
Passenger Duty
Passenger, or if a minor, his or her parent or guardian, shall be liable to, and shall reimburse Released Parties for, any damage to the Released Parties’ property, the Vessel, the Transport or any property of NCL caused directly or indirectly, in whole or in part, by any willful or negligent act or omission on the part of the Passenger; and Passenger, or if a minor, his or her parent or guardian, shall further indemnify the Released Parties and each and all of their agents and servants against all liability which the Released Parties may incur towards any person or company or government for any personal injury, death or damage to property caused directly or indirectly, in whole or in part, by any willful or negligent act or omission on the part of Passenger.
Guest Conduct Policy
MB and NCL will not tolerate any behavior by Guest which negatively affects the comfort, enjoyment, health, safety or well being of other Motörhead’s Motörboat passengers, its performers and staff, other onboard guests or the ship’s crew. MB and NCL do not permit nudity in any of the vessel’s public venues and enforces it’s Freestyle Dress Code. Audio equipment used for personal entertainment may be brought on board but cannot be played at levels disruptive to other guests. Headphone use is strongly recommended. Violation of this policy will result in the confiscation of the equipment.
Guest agrees to comply with this policy, and further acknowledges that MB and/or NCL reserve the right to refuse or discontinue passage to any guest who, in judgment of MB management and/or NCL vessel management, violates NCL’s Guest Conduct Policy or who is deemed a danger to himself, herself or others, or is conducting themselves in a manner that otherwise adversely affects the overall cruise experience of others. In all cases MB and NCL shall not be liable for any damages, refund or other compensation, including travel costs.
Illegal Substances
MB and NCL strictly prohibit the possession, distribution or use of non-prescription drugs of ANY KIND onboard the vessel. All passengers must agree to comply with this policy, and further acknowledges that that any passengers who are found with such illegal substances will not be allowed to board or will be disembarked at the next port of call.
Guest acknowledges that it is MB and NCL’s policy to report incidents of illegal activity or behavior to the appropriate law enforcement authorities for appropriate legal action. In such cases MB and NCL shall not be liable for any damages, refund or other compensation, including travel costs.
Alcoholic Beverages
Passengers must be 21 years of age or older to purchase or consume alcohol onboard the vessel. MB and NCL permit young adults between the agest of 18-20 to purchase and consume wine and beer ONLY while onboard, and ONLY with the full and witnessed consent of an accompanying parent. The parent or legal guardian must be onboard the sailing with the young adult and present themselves at the Front Desk so they can sign a document allowing the consumption of beer and wine only. A notarized Parent Consent Form or any other document allowing for temporary guardianship for the purposes of the sailing only will NOT be accepted. Please note that with the exception of Wine and Champagne, all guests are prohibited from bringing alcohol on board our ships.
MB and NCL encourage the responsible use of alcohol and accordingly reserves the right to permanently or temporarily revoke the drinking privileges of any guest who violates NCL’s Guest Conduct Policy or who is deemed a danger to himself, herself or others by MB management and/or NCL vessel management. Continued abuse of alcohol while sailing and/or violation of MB and NCL’s alcohol policy may result in immediate disembarkation. In such cases MB and NCL shall not be liable for damages, refund or other compensation, including travel costs.
Smoking Policy
All public areas throughout the vessel are smoke-free. SMOKING NOT ALLOWED IN CABINS OR ON BALCONIES. Smoking inside your stateroom WILL result in a $250 cleaning charge added to your onboard account.
If you smoke regular or electronic cigarettes, you may do so in designated areas only within the casino or in the Cigar Bar. If you prefer pipes or cigars, you may smoke in the Cigar Bar or designated smoking lounge. Also, you may smoke cigarettes, pipes and cigars outside on open decks, but not in proximity to food venues, sports decks, kids’ pool areas and other designated non-smoking areas.
Guest agrees to comply with this policy and further acknowledges that any violation of this policy could result in disembarkation from the vessel, as well as additional fines levied by MB and/or NCL. In such cases MB and NCL shall not be liable for damages, refund or other compensation, including travel costs.
Moshing, Crowd Surfing and Stage Diving Policy
To ensure the health and safety of all Motörhead’s Motörboat guests, no moshing, crowd surfing or stage diving will be permitted during music performances onboard the ship, or while in port at Great Stirrup Cay. Guest agrees to comply with this policy, and further acknowledges that MB management and/or NCL vessel management reserve the right to remove any guest in violation of this policy from the performance area. Continued violation of this policy may result in disembarkation. In such cases MB and NCL shall not be liable for damages, refund or other compensation, including travel costs.
Limitation Of Liability
By booking the Cruise, you (the guest) agree to release and hold harmless the Released Parties, from and against any claim or cause of action arising out of or in connection with your travel on and participation in the Cruise, including, but not limited to: (1) injury, death or delay of passengers, or loss, damage or delay of or to passengers’ baggage or other property, which may be caused, directly or indirectly, in whole or in part, from participation in the Cruise, including, without limitation, passenger’s use of or participation in any shore excursion, on board concession or athletic or recreational activity; (2) your request for or selection of a roommate for the Cruise; (3) emotional distress, mental suffering or anguish or psychological injury of any kind under any circumstances (except when such damages were caused by the Released Parties’ negligence and resulted from the same passenger’s sustaining actual physical injury, or having been at risk of actual physical injury, or when such damages are held to have been intentionally inflicted by the Released Parties); (4) any change in scheduled Cruise events and/or celebrity appearances; or (5) NCL Cruisess exercise of its contractual rights (see below). You further agree that the Released Parties shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by any of the Released Parties, nor for any intentional or negligent acts of any of the Released Parties’ employees committed while off duty or outside the course and scope of their employment.
In the event that a court of competent jurisdiction holds any of the foregoing to be unenforceable, then the Released Parties’ liability shall be limited to the maximum extent permitted by law. In addition, in such case:
- Claims for Personal Injury, Illness or Death: – The Released Parties shall not be liable for any claims whatsoever for personal injury, illness or death of a passenger, unless full particulars in writing are given to MB within 185 days after the date of the injury, event, illness or death giving rise to the claim. Suit to recover on any such claim shall not be maintainable unless filed within one (1) year after the date of the injury, event, illness or death, and unless served on MB within 120 days after filing. You (the passenger) expressly waive all other potentially applicable state or federal limitations periods.
- Claims other than Personal Injury, Illness or Death: – The Released Parties shall not be liable for any claims whatsoever, other than for personal injury, illness or death of a passenger, unless full particulars in writing are given to MB within 30 days after the passenger is landed from the Cruise, or if the Cruise is abandoned, within 30 days thereafter. Suit to recover on any claim whatsoever other than for personal injury, illness or death shall not be maintainable unless filed within six months after the date the passenger is landed from the Cruise or the Cruise is abandoned, and unless served upon MB within 120 days after filing. You (the passenger) expressly waive all other potentially applicable state or federal limitations periods.
THE EXCLUSIONS OR LIMITATIONS OF LIABILITY OF THE RELEASED PARTIES SET FORTH IN THE PROVISIONS OF THIS CONTRACT SHALL ALSO APPLY TO AND BE FOR THE BENEFIT OF AGENTS, INDEPENDENT CONTRACTORS, CONCESSIONAIRES AND SUPPLIERS OF THE RELEASED PARTIES, TOGETHER WITH THE EMPLOYEES AND SERVANTS OF EACH OF THE FOREGOING. WITHOUT LIMITING THE PRECEDING SENTENCE, IN NO EVENT WILL THE RELEASED PARTIES OR NCL BE LIABLE TO PASSENGER FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES.
Decisions Of NCL
You will receive NCL’s Guest Ticket Contract (the “NCL Contract”) with your Cruise ticket. The NCL Contract constitutes your agreement with NCL. The NCL Contract provide that NCL may exercise its rights in a variety of matters, including, without limitation: Its right to alter the ship’s course, ports of call, itinerary, activity and shore excursions, for any reason, to ensure the comfort and safety of the passengers and crew;
Its decision to comply with any order, recommendation or direction given by any government or other person or MB; and Its decision to deny boarding to, confine to a stateroom or disembark any Cruise passenger. The Released Parties (as defined above) shall not be liable to you or any third party for any claim or cause of action arising, directly or indirectly, in whole or in part, out of NCL exercise of any of its rights as provided in the NCL Terms. Without limiting the foregoing, the Released Parties shall not be liable to any Cruise passenger for a full or partial refund of any Cruise fare, or for any lodging or transportation expenses, as a result of NCL exercise of its contractual rights.
Disputes
NCL reserves the right to substitute the Cruise vessel. Any consequences arising out of NCL exercise of this right shall be governed by the agreement between NCL and MB, and not by NCL agreement with you, the guest. Furthermore, in the event of any conflict between the NCL Terms and these Terms and Conditions, these Terms and Conditions will prevail. In addition, NCL and/or MB may reassign cabins as determined necessary or desirable by the Vessel’s Safety Department or MB, in their sole discretion.
Miscellaneous
NCL reserves the right to substitute the Cruise vessel. Any consequences arising out of NCL exercise of this right shall be governed by the agreement between NCL and MB, and not by NCL agreement with you, the guest. Furthermore, in the event of any conflict between the NCL Terms and these Terms and Conditions, these Terms and Conditions will prevail. In addition, NCL and/or MB may reassign cabins as determined necessary or desirable by the Vessel’s Safety Department or MB, in their sole discretion.

Guest acknowledges and confirms that any travel agent utilized by guest in connection with the issuance of this ticket is, for all purposes, guest’s agent and the Released Parties shall not be liable for any representation made by said travel agent. Guest shall at all times remain liable to MB for the price of passage.
In addition to the restrictions and exemptions from liability provided in these Terms and Conditions, the Released Parties shall have the full benefit of any applicable laws providing for limitation and exoneration from liability, and nothing in contained herein is intended to operate to limit or deprive the Released Parties of any such statutory limitation of or exoneration from liability. Without limiting the foregoing, the Released Parties claim benefit of all restrictions, exemptions and limitations of the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1974 as well as the Protocol to the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1976 (“Athens Convention”), which limits the liability of the Released Parties for the death of or personal injury to a guest to no more than the applicable amount of Special Drawing Rights as defined therein, and all other limits on damage or loss to personal property.
These Terms and Conditions and the terms accepted during the cruise reservation process contain the entire agreement between MB and Passenger and supersedes any other agreements, written or oral, relating to the subject matter herein. Any waiver of any provision of must be made in writing and signed by an authorized representative of MB. If any portion of shall be determined to be invalid, then said portion shall be deemed severed from the Contract in such jurisdiction only and all remaining portions shall remain in full force and effect.
